All software products (Expert Advisors, Indicators, Scripts) available on this platform are provided for technical analysis, educational, and research purposes only. Nothing on this website constitutes financial advice or a recommendation to buy or sell any financial instrument.

You are solely responsible for any trading decisions and should consult with a qualified financial professional before making any investment decisions.

1. Agreement Acceptance

By accessing, browsing, or using the Forex Algo-Trader website ("Platform"), purchasing products, or listing products as a Vendor, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you must immediately cease using our services.

These Terms constitute a legal agreement between you and Forex Algo-Trader Marketplace (operated by Algohub).

2. Marketplace Nature

Forex Algo-Trader operates as a digital marketplace platform connecting independent software developers ("Vendors") with users ("Buyers"). We provide the technological infrastructure for transactions but are not the creators, sellers, or endorsers of the products listed.

Platform Responsibilities:

Providing secure payment processing infrastructure
Hosting Vendor product listings and descriptions
Facilitating communication between Buyers and Vendors
Managing license key generation and distribution

Vendor Responsibilities:

Creating and maintaining their software products
Providing accurate product descriptions and documentation
Offering technical support for their products
Ensuring their software is free from malware and viruses

3. Digital Products & Refund Policy

DIGITAL PRODUCTS ARE NON-REFUNDABLE

Due to the nature of digital intellectual property and immediate access to downloadable content, all sales of software products (EAs, Indicators, Scripts) are FINAL once the download link has been accessed or the license key has been generated.

Strict Refund Exceptions: Refunds may only be considered under these specific circumstances:

Technical Failure: The downloaded file is corrupted and cannot be opened/installed
Material Misrepresentation: The product description was significantly inaccurate regarding core features
Support Failure: The Vendor fails to provide promised technical support within 7 business days
Duplicate Purchase: Accidental duplicate purchase of the same product (must be reported within 24 hours)

Non-Refundable Circumstances (Examples):

Trading losses or poor market performance
Change of mind or dissatisfaction with trading results
Incompatibility with your trading strategy or expectations
Failure to achieve desired profit levels
Market conditions or volatility

All refund requests must be submitted via email to support@forexalgotrader.com within 14 calendar days of purchase and must include proof of the issue.

4. Payment Processing & Data Protection

SECURE PAYMENT PROCESSING

We utilize industry-standard payment processors to handle all transactions securely. By making a purchase, you agree to the respective terms of service of our payment processors.

Data Protection Compliance: We operate in compliance with the Kenya Data Protection Act, 2019. Your financial data (credit card numbers, etc.) is never stored on our servers. We only share necessary transaction data with our payment processors for:

Transaction completion and verification
Fraud prevention and security
Regulatory compliance requirements

Data We Share with Payment Processors:

Name and contact information (for transaction verification)
Email address (for receipt delivery)
Transaction amount and currency
IP address (for fraud prevention)

5. Liability & Disclaimers

Platform Liability Limitation: Forex Algo-Trader acts as an intermediary platform only. We are not responsible for:

The functionality, performance, or profitability of Vendor products
Technical issues arising from Vendor software
Trading losses incurred while using purchased software
Accuracy of Vendor product descriptions or claims
Compatibility issues with specific trading platforms or configurations

Vendor Warranties: By listing products on our platform, Vendors warrant that:

They own or have licensed all intellectual property rights
Their software contains no malicious code, viruses, or malware
Product descriptions are accurate and not misleading
They will provide reasonable technical support

Service Availability: The Platform is provided on an "as-is" and "as-available" basis. We make no warranties regarding uninterrupted access or specific functionality.

6. Intellectual Property & Licenses

When you purchase software on Forex Algo-Trader, you are purchasing a Limited User License for personal use only, unless otherwise specified by the Vendor.

Prohibited Activities:

Reselling or redistributing purchased software without explicit reseller rights
Decompiling, reverse-engineering, or modifying the software code
Using purchased software on multiple computers beyond the licensed limit
Sharing license keys or download links with others

Intellectual property rights remain with the original Vendor. License terms are specified in each product's description.

7. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Jurisdiction: Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.

DPA Compliance: All data processing activities comply with the Kenya Data Protection Act, 2019, and relevant data protection regulations.

8. Amendments & Updates

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. The "Last Updated" date will reflect the most recent changes.

Your continued use of the Platform after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically for updates.
